These Terms and Conditions set out the basis on which Man With a Van Mitcham provides man and van, removals, collection and delivery services to private and business customers within our service areas. By making a booking, you agree that these Terms and Conditions form the entire agreement between you and Man With a Van Mitcham in relation to the services provided.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means the person, firm or company who requests and pays for the services.

We, us, our means Man With a Van Mitcham.

Services means any man and van, removals, transport, collection, delivery, loading, unloading or related services we agree to provide.

Goods means the items that you ask us to move, transport or handle.

Booking means a confirmed request for services, whether made by telephone, online form, or in writing.

2. Scope of Services

Man With a Van Mitcham provides man and van and general removal services within Mitcham and surrounding areas, as well as to and from other locations within the United Kingdom as agreed at the time of booking.

Our services may include loading, transporting and unloading your goods, as well as optional services such as packing and unpacking when expressly agreed in advance. Any service not expressly agreed at the time of booking is deemed to be excluded.

3. Booking Process

You may request a quotation by providing accurate details regarding collection and delivery addresses, access conditions, property type, floor level, parking arrangements, dates, times and a clear description of the items to be moved.

All quotations are based on the information you supply. If the information provided is inaccurate or incomplete, we reserve the right to amend or withdraw the quotation or to charge additional fees on the day of the move.

A booking is only confirmed when we have accepted your request and you have accepted our quotation and any required deposit has been paid. Provision of a quotation alone does not constitute a confirmed booking.

By confirming a booking, you warrant that:

You are at least 18 years of age.

You are the owner of the goods or have full authority from the owner to enter into this agreement.

You are able to allow access to the premises at the agreed times.

4. Access, Parking and Your Responsibilities

You are responsible for ensuring that suitable parking is available for our vehicle at both the collection and delivery addresses for the duration of the services. Any parking permits, dispensations or visitor tickets must be arranged in advance by you unless we have agreed otherwise in writing.

If parking is unavailable, restricted, or results in fines or penalties, you will be liable for any associated costs. We are entitled to add such costs to your final invoice.

You must ensure that:

All goods are packed, prepared and ready to be moved unless we have agreed to provide packing services.

All fragile, delicate or high-value items are appropriately protected and clearly marked.

All access routes, stairways, lifts and corridors are clear and safe for our staff and the goods.

We are notified in advance of any access issues such as narrow roads, low bridges, weight restrictions, limited turning space, or internal access issues such as spiral staircases or restricted doorways.

Where access is significantly more difficult than described at the time of booking, we may charge additional fees for the extra time or labour required, or in extreme cases we may refuse to complete the job if it cannot be carried out safely.

5. Payments and Charges

Unless otherwise agreed, our charges are based on either an hourly rate or a fixed price quotation. All charges are exclusive of any additional costs such as congestion charges, tolls, parking fees or penalties, which will be added to your final invoice where applicable.

We may require a deposit at the time of booking. The balance of payment is normally due immediately upon completion of the services, unless we have agreed alternative terms in advance for business customers.

We accept common UK payment methods as advised at the time of booking. You agree to pay any bank charges or transaction fees associated with your chosen method of payment.

If payment is not made when due, we reserve the right to:

Charge interest on the overdue amount at the statutory rate, accruing daily until payment is received.

Withhold delivery of goods until full payment is received, where lawful and appropriate to do so.

Pursue debt recovery action, and you will be liable for all reasonable costs incurred in recovering overdue sums.

6. Changes to Bookings

If you need to amend your booking, including the date, time, addresses or size of the job, you must notify us as early as possible. Any changes are subject to our availability and may result in a revised quotation.

Where changes increase the time, distance or labour required, we may charge additional fees which you will be informed of before the services proceed. If we are unable to accommodate a requested change, the original booking and cancellation terms will apply.

7. Cancellations and Postponements

You may cancel or postpone your booking by giving us notice. The following cancellation terms apply unless otherwise agreed in writing:

If you cancel more than 7 days before the scheduled service date, any deposit paid may be refunded or credited at our discretion, less any reasonable administrative costs.

If you cancel between 7 days and 48 hours before the scheduled service date, we may retain part or all of your deposit to cover allocated resources and lost bookings.

If you cancel with less than 48 hours notice, or fail to be present at the agreed time, we reserve the right to charge up to 100 percent of the quoted price.

If we need to cancel or postpone your booking due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents or other force majeure events, we will notify you as soon as reasonably practicable and offer an alternative date or a refund of any pre-paid amounts. We will not be liable for any indirect loss or consequential loss arising from such cancellation or postponement.

8. Exclusions and Prohibited Items

We do not carry goods that are dangerous, illegal, flammable, explosive, corrosive or otherwise hazardous, including but not limited to gas cylinders, firearms, ammunition, illegal substances, chemicals, paints, solvents or toxic materials.

We also do not transport live animals, perishable goods, or any items requiring special licences or temperature-controlled conditions unless expressly agreed in writing prior to booking.

If you submit such prohibited items without our knowledge or consent, you do so entirely at your own risk. We may remove, refuse to transport or dispose of such items without notice and you will be liable for any associated costs, damages or claims.

9. Waste Regulations and Disposal of Items

Man With a Van Mitcham operates in accordance with applicable UK waste management and environmental regulations. We are not a general waste disposal service and will not remove household rubbish, construction waste or other general refuse unless specifically agreed in advance and carried out in compliance with relevant regulations.

You must not request us to dispose of items illegally or in a way that breaches local or national waste laws. Where we agree to remove items for disposal or recycling, such services may incur additional charges which will be confirmed before the work is carried out.

We reserve the right to refuse removal of any items that we reasonably believe may breach waste or environmental regulations or pose a health and safety risk.

10. Our Liability

We will exercise reasonable care and skill in providing our services and handling your goods. However, our liability is subject to the limitations set out in these Terms and Conditions.

We are not liable for loss or damage arising from:

Poorly packed goods where we did not carry out the packing.

Pre-existing damage, defects or wear and tear in your goods.

Normal scratching, scuffing or wear that may reasonably occur when moving large items through tight spaces.

Loss or damage to goods packed by you in boxes or containers that we did not seal.

Electrical or mechanical derangement of appliances, instruments or equipment unless there is clear external damage caused by our negligence.

Loss of data, files or software from computers or electronic devices.

Any loss of value of antiques, artwork, or high-value items unless you have declared their value in advance and we have agreed in writing to accept enhanced responsibility.

We will not be liable for any loss of profits, loss of business, loss of opportunity or other indirect or consequential loss, even if foreseeable.

Our total liability for loss of or damage to your goods caused by our negligence or breach of contract shall not exceed a fair market value of the damaged goods subject to any agreed limit and subject always to you providing evidence of value and damage.

11. Customer Obligations and Indemnity

You agree to:

Provide accurate information at the time of quotation and booking.

Be present or represented at the collection and delivery addresses at the agreed times.

Check that nothing is left behind before our staff leave the property.

Pay all charges due under these Terms and Conditions.

You will indemnify us against any claims, costs, damages or losses arising from:

Your breach of these Terms and Conditions.

Your failure to obtain necessary permissions, permits or consents for us to carry out the services.

The presence of hazardous, illegal or prohibited items among your goods.

12. Insurance

We recommend that you maintain suitable insurance cover for your goods during removal and transport. While we will take reasonable care, some household or business contents policies already provide cover for goods in transit when moved by a professional removal service. It is your responsibility to check with your insurer and arrange additional cover if required.

Where we offer or arrange any additional insurance or extended liability, this will be subject to separate terms, conditions and charges which will be communicated to you before you agree to such cover.

13. Complaints

If you have a complaint about our services, you should raise it with us as soon as possible, ideally on the day of the move, so that we have an opportunity to investigate and, where appropriate, rectify the situation promptly.

Any claim for loss or damage to goods must be notified to us in writing as soon as reasonably practicable and in any event within 7 days of the date of the services. You should provide full details, including photographs and evidence of value where relevant, to enable us to assess the claim.

Failure to notify us within this timeframe may affect our ability to investigate and may reduce or extinguish any liability we may have.

14. Data Protection and Privacy

In the course of providing our services, we will collect and process personal data such as your name, address, contact details and details of your booking. We will use this information solely for the purpose of managing your enquiry, providing the services, handling payments, and dealing with any queries or complaints.

We will store your information securely and will not share it with third parties except where necessary for the performance of the contract, for legal or regulatory reasons, or with your explicit consent.

15. Amendments to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in law, operational needs or service offerings. The version in force at the time of your booking will apply to your contract with us. You are advised to review the Terms and Conditions each time you make a new booking.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services provided by Man With a Van Mitcham shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, including any non-contractual disputes or claims.

17. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but such deletion shall not affect the validity and enforceability of the remaining provisions.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between you and Man With a Van Mitcham in relation to the services and supersede any prior discussions, correspondence, understandings or agreements.

By confirming a booking, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
